What Means Wrongful Death?
Whenever a person dies or is killed due to actions, negligence or misconduct of someone else, the surviving members of the victim’s family may sue for “wrongful death.” That person (or company) can be held liable for wrongful death, regardless of being convicted of a crime associated with that death.
Wrongful death claims are brought in a civil action, usually by close relatives. Each state has different laws regarding wrongful death claims. In most states, the statute of limitations (time limit to file a case) varies according to how the death occurred.
Compensation For Your Emotional And Financial Loss
Any type of accident can turn fatal. Car accidents as well as truck accidents and motorcycle accidents often leave individuals with severe and life-threatening injuries. When accidental deaths occur, family members often find themselves not only reeling from their emotional loss, but also struggling to pay bills. Large medical bills incurred before death, funeral costs, and loss of the deceased’s income and benefits, can place entire families under financial strain.
In California, there are two types of wrongful death claims. The first is based on the pain and suffering experienced by fatal accident victims before their death. The second applies to the loss of consortium and other emotional and financial losses experienced by surviving family members.
